Why You Need Legal Advice Before You Sign

Retirement village contracts are complex, and getting the wrong advice—or none at all—can leave you or your estate exposed.

These are not typical property purchases. Most Queensland villages operate under leasehold or licence agreements, where you don’t own the unit outright. Instead, you’re entering into a long-term contract that includes detailed terms about fees, exit contributions, dispute processes, and your rights as a resident.

Here’s what we help you understand before you commit:

  • Final contributions: Many contracts include a deferred management fee of up to 30–40% of the purchase price, taken when you leave or your unit is resold.

  • Ongoing costs: Monthly fees often continue after you move out, and may increase over time.

  • Impact on your estate: How your contract is structured can affect what your family receives when your rights are transferred or terminated.
  • Contract type: You may be entering into one of four legal contract types—Resident Contract, Excluded Contract, Licence to Occupy, or a Company Share Arrangement. Each has different implications for tenure, rights, and responsibilities.
  • Financial risk: Operators are legally required to supply key disclosure documents, but these don’t always tell the full story. We help you understand the fine print and how the Retirement Villages Act 1999 protects you.
