Common Property Issues We've Helped Clients Overcome

Property disputes can be a significant source of stress, potentially threatening your rights and financial interests. Whether the issue involves boundaries, contracts, or ownership, having an experienced property lawyer by your side can make all the difference in achieving a fair and timely resolution.

Boundary disputes often arise from unclear or incorrect property lines, leading to disagreements between neighbours. These disputes can quickly escalate, causing friction and potentially resulting in costly legal battles. At Arcuri Turnbull Law, we work closely with licensed surveyors to establish accurate property boundaries. Our legal team then negotiates on your behalf to resolve disputes amicably. However, if necessary, we are prepared to represent you in court to ensure your property rights are fully protected.

Contract disputes in property transactions can stem from misunderstandings, misinterpretations, or breaches of agreement. Such conflicts can delay transactions and lead to financial losses if not handled promptly. Our property lawyers are highly skilled in contract law, allowing us to swiftly identify the root of the dispute and work towards a resolution that aligns with your interests. Whether through negotiation, mediation, or litigation, we are committed to upholding your contractual rights.

Title disputes present challenges to property ownership, often involving claims by previous owners, errors in public records, or fraudulent activity. These disputes can complicate property sales and threaten your ownership. We conduct thorough title investigations to resolve any discrepancies and provide robust legal representation to defend your ownership claims, ensuring you can move forward with confidence in your property transactions.

Disagreements between landlords and tenants can arise over various issues, including lease terms, property maintenance, rent payments, and eviction processes. These disputes can strain relationships and, if not managed correctly, lead to legal action. Our team offers comprehensive legal support for both landlords and tenants, helping to resolve conflicts through negotiation. When necessary, we also represent your interests in court, ensuring compliance with tenancy laws and protecting your rights.

Easement and right of way disputes occur when there is disagreement over access to or use of a property. Such disputes can lead to conflicts with neighbours or other parties. We provide expert advice on these matters, helping to clarify terms and negotiate solutions that respect both your property rights and those of others involved. If a resolution cannot be reached amicably, we offer robust legal representation to safeguard your interests.

Zoning and land use disputes are common when property use conflicts with local regulations or when proposed developments face opposition from the community. These disputes can halt or delay your property plans, resulting in financial loss. Our lawyers are well-versed in zoning laws and land use regulations, advocating on your behalf in negotiations with local councils and representing you in hearings. We provide strategic advice to ensure your property use aligns with legal requirements and your goals.

Environmental and compliance disputes, particularly for commercial properties, can arise if a property is found to be in violation of environmental laws. Such violations can lead to fines, legal action, and costly remediation efforts. At Arcuri Turnbull Law, we guide you through environmental regulations, ensuring your property complies with all relevant laws. If disputes do arise, we provide strong legal representation to defend your interests and work towards a resolution that minimises your liability.

We understand that property disputes are complex and often stressful. Our team is committed to delivering clear, effective legal solutions tailored to your specific situation, ensuring that your property rights and investments are fully protected. Book a free consultation today to find out how we can help safeguard your interests.

Frequently Asked Questions

Because property issues can escalate quickly, getting early legal advice can save you time, stress, and money, which is why we recommend you contact us anytime you’re not sure about your rights or obligations. We help clients at all stages, whether you’re reviewing a contract, managing a dispute with a neighbour, navigating a zoning issue, or just unsure about your legal rights. If something doesn’t feel quite right, or you’re being asked to sign something you don’t fully understand, that’s a good time to give us a call. It’s much easier to protect your interests before a situation gets out of hand.

A conveyancer helps with the legal paperwork for buying and selling property. A property lawyer can do that too, but also gives legal advice and handles more complex matters like disputes, ownership issues, or contract problems.

At Arcuri Turnbull Law, we offer both conveyancing and property law services. That means whether your transaction is straightforward or something unexpected comes up, you won’t need to go anywhere else; we’ve got the expertise to handle it all in-house.

Bring anything that helps us understand your situation clearly. That might include your contract of sale, lease agreement, title documents, plans or surveys, council notices, or any letters or emails you’ve received. If you’re dealing with a dispute, written communication with the other party is also helpful. Don’t worry if you’re not sure what’s relevant, just bring what you have, and we’ll help you make sense of it. Our goal in that first meeting is to understand where you stand, what your options are, and how we can help move things forward.

Yes, you can, but it’s not as simple as just handing over the keys. Transferring property to a spouse, child, or other family member still involves legal paperwork, possible stamp duty, and sometimes tax implications. We can help you understand your options, prepare the transfer documents, and manage any financial or legal risks that may arise. Whether it’s part of a separation, a gift, or estate planning, we’ll make sure it’s done properly and in your best interests.

It depends. Stamp duty may still apply even if no money is changing hands, especially if the transfer is not between spouses or de facto partners. Queensland has strict rules around exemptions and concessions, so it’s worth getting legal advice before proceeding. We’ll help you understand what applies in your case and assist with any required declarations or paperwork to minimise unnecessary costs.

Start by knowing what matters to you: rent, lease length, outgoings, renewal options, and who’s responsible for repairs. From there, we can help you review the lease and identify clauses that could be risky or unfair. We’ll work with you to negotiate terms that suit your business and protect you in the long run. Don’t sign anything until you’re clear on what you’re agreeing to as commercial leases are legally binding and can be difficult to get out of later.

As a commercial tenant, you’re usually responsible for paying rent and outgoings, keeping the premises in good condition, and complying with the terms of your lease. Some leases also require you to pay for repairs, insurance, or even upgrades. It’s important to know exactly what you’re agreeing to, as breaching the lease could lead to penalties or termination. We can review your lease and explain your obligations in plain English so there are no surprises later.

Yes — and it’s often part of a property settlement. If you and your ex-partner agree on who keeps the property, a legal transfer can be arranged. This usually involves formalising the agreement through consent orders or a binding financial agreement, and lodging a transfer form with the Titles Office. There may be exemptions from stamp duty in certain situations. We can guide you through the process and make sure the transfer is done legally and fairly.

A retail lease usually applies to premises where goods or services are sold directly to the public, like shops, salons, or cafes. These leases are covered by specific legislation that provides extra protections for tenants. A commercial lease, on the other hand, covers offices, warehouses, or other non-retail spaces and is often more flexible but less regulated. We’re experienced with both retail and commercial lease agreements and can help you understand what type of lease applies and what that means for your rights and responsibilities.
