The Deceased Estate process in Queensland, also known as Probate or Estate Administration, refers to the legal steps that must be taken after someone passes away. If the person had a Will, it usually guides the distribution of their estate. However, disputes can arise over the Will and property distribution.

An executor is appointed under a Will, whose role is to oversee the administration and distribution of the estate to named beneficiaries. The executor will manage assets, pay debts, sign paperwork and ensure the distribution aligns with the deceased’s wishes. The Deceased Estate Process:


Obtain a Death Certificate

The first step is obtaining the death certificate to establish the date of death and gain legal authority to manage the assets.


Identify and locate Assets

We help identify all assets owned by the deceased, including bank accounts, real estate, investments and personal property.


Apply for Probate

If there's a valid Will, the named executor can apply for Probate, confirming the Will's validity and granting the authority to administer the estate.


Settle Debts and Taxes

Before distributing assets to beneficiaries, outstanding debts and taxes are settled, ensuring a smooth distribution process.


Distribute the Assets

Once debts are cleared, assets are distributed as per the Will's instructions.

Frequently Asked Questions

It depends on the assets of the Estate. In Queensland, you do not automatically have to apply for Probate if you own property. In New South Wales, if the deceased owns property, then Probate is required.

The process takes about 3-4 months.

We recommend that the funds be distributed after 6 months from the date of death. When Probate is required, this timeframe could be longer.
